Here, gold would have lost the repetition fight, because on 21g, he was the first one to produce a position that had already been on the board (and hence he would have been the first to reproduce a position for the third time). So silver could have pushed back into d2 on 21s, and gold would have had to play something different.

If that holds in general, why not supplement the repetition rule by saying you can't recreate the position from the end of your prior turn?
